Terms of Service

These terms are an agreement between you and ThirdSIM, a company registered in Bangladesh (“we”, “us”), which operates ThirdSIM. By creating an account, buying data or a phone number, or adding credit to your wallet, you accept them.
If you do not accept them, do not use the service. You can stop at any time: close your account from the app or write to support@thirdsim.com.
Who we are and what we sell
ThirdSIM sells two things:
- Travel eSIM data plans. A data-only mobile subscription you install on an eSIM-capable phone, for use in one country or a group of countries, for a fixed amount of data and a fixed number of days.
- Virtual phone numbers in the United States, the United Kingdom and Canada, used for calls and text messages over an internet connection inside our app.
We are a reseller. The mobile networks, the eSIM platforms and the telephony carriers behind these products are operated by third parties. We choose them, we pay them, and we are responsible to you for what we sell — but we do not own the radio networks and we cannot guarantee their coverage or capacity.
Our postal address is our registered address, available on request from support.
Your account
You need an account to buy anything. You must be at least 18 years old, or old enough in your country to enter into a contract, and you must give us accurate details.
You are responsible for everything done through your account. Keep your sign-in method secure. Tell us immediately at support@thirdsim.com if you believe someone else has access to it.
One person, one account. We may close duplicate accounts opened to claim referral credit or promotional discounts more than once.
We may suspend or close an account that breaks these terms, our Acceptable Use Policy or the law, or where we are required to by a regulator, a carrier or a payment provider. Where we can, we tell you why and give you a chance to put it right.
Prices, currency and taxes
Prices are shown before you pay, in the currency displayed in the app or on the site. Our base currency is US dollars; any other currency shown is a conversion for your convenience and may move between the moment you see it and the moment your bank settles it.
Wholesale costs change. We reprice our catalogue regularly, so the price of the same plan may differ from one week to the next. The price you are shown at checkout is the price you pay for that purchase.
You are responsible for any taxes, duties or bank charges that apply to you where you live.
Wallet credit
Your wallet holds prepaid credit in your account currency. It is a balance you can spend with us. It is not a bank account, not electronic money and not a deposit.
- Credit can be spent on eSIM data, top-ups, phone numbers, calls and messages.
- Credit cannot be withdrawn to cash or to a bank account. It has no value outside ThirdSIM.
- Credit cannot be sold or transferred to anyone else, except through the in-app “send credit” feature between ThirdSIM accounts, subject to the limits shown in the app.
- Credit added by us as a promotion, a referral reward or goodwill may carry its own conditions, and cannot be sent to another account.
- Refunds are made to wallet credit unless we say otherwise. See the Refund Policy.
If you close your account, any remaining credit is lost. Spend it or ask support before you close.
If your account has been inactive for a long period we may contact you before taking any action on a remaining balance; we will always try to reach you first.
eSIM data plans
Validity starts on first connection. A data plan does not begin when you buy it or when you install it. It begins the first time the eSIM connects to a network in the covered area, and it then runs for the number of days shown, ending at the end of that period even if data is left.
Other things to know:
- Data is for personal use on the device where the eSIM is installed. Hotspot and tethering are allowed unless the plan page says otherwise.
- Speeds depend on the local network, the time of day and your device. Where a plan says “5G”, 5G is used where the local network offers it and your device supports it.
- The plan carries data only. It does not include calls or text messages on that line. Your home SIM stays available for calls and bank codes.
- Top-ups add data and days to an existing eSIM, where the underlying plan supports them. A top-up follows the same rules as the original plan.
- An eSIM profile can usually be installed only once. If you delete it from your phone, you may not be able to reinstall it. Check the install guide before removing a profile.
- Some countries restrict roaming traffic, voice-over-IP or particular services. We cannot change local rules.
Phone numbers
Virtual numbers are covered in detail by the Virtual Numbers Policy. In summary:
- A number is rented monthly and renewed automatically from your wallet.
- Calls and messages are billed from your wallet at the rates shown in the app.
- These numbers are not suitable for receiving verification codes from services such as WhatsApp, Telegram, banks or social networks. Many providers block virtual numbers outright. Using our numbers for that is a breach of our Acceptable Use Policy.
- These numbers do not reliably reach emergency services. They work over the internet, they are not tied to your physical location, and you must not rely on them in an emergency. Keep a working local line for emergency calls.
- If renewal fails for lack of credit, the number is suspended after 3 days, released after 10, and held in quarantine for 30 days before it can be reissued. A released number cannot be recovered.
Referrals and promotions
Referral credit is granted under the conditions shown on the referral screen at the time you share your link. In general: your friend gets a discount on their first paid order, and you are credited once that order has been fulfilled.
We may withhold or reverse referral and promotional credit obtained through duplicate accounts, false details, automated sign-ups or any other abuse, and may close the accounts involved.
Identity checks and sanctions
We may ask you to verify your email address or phone number, and in some cases to confirm your identity, before we sell you a number or release a large balance. We may refuse or delay a purchase while a check is outstanding.
We do not sell to people or organisations subject to applicable sanctions, and we do not provide service into countries or territories where doing so would be unlawful for us or for our carriers. We may refuse or cancel an order on those grounds and refund it.
Fair use, lawful use
You agree to use the service lawfully and not to use it to harass, defraud, spam or harm anyone, to hide your identity for an unlawful purpose, or to resell it without a written agreement with us. The Acceptable Use Policy sets this out in full and forms part of these terms.
Service availability
We aim to keep the service available and to fix problems quickly, but we do not promise uninterrupted service. Networks fail, vendors have outages, and maintenance happens. Where a failure is ours and it prevented you from using something you paid for, tell support and we will put it right.
Our responsibility to you
We are responsible for providing what you bought, with reasonable skill and care.
We are not responsible for:
- coverage, speed or capacity of a mobile network we do not operate;
- your device, its settings, its compatibility or a carrier lock on it;
- a service that blocks or refuses virtual numbers;
- loss caused by your own breach of these terms.
Where we are liable, our total liability to you for any claim is limited to the amount you paid us for the product the claim relates to in the 12 months before the claim, or the amount of your wallet balance held at the time, whichever is greater. We do not exclude liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.
We are not liable for indirect or consequential loss, including lost profit, lost data or a missed booking.
Changes to these terms
We may change these terms — for example when we add a product, when a carrier changes a rule, or when the law changes. This page always shows the version in force, with its version number and effective date. We keep every earlier version and will send you any of them if you ask at support@thirdsim.com.
If a change materially affects you, we will tell you in the app or by email before it takes effect, and ask you to accept the new version the next time you buy something. Continuing to use the service after the effective date means you accept the change.
Complaints and disputes
If something goes wrong, write to support@thirdsim.com or open a ticket in the app. Tell us the order reference and what happened. We aim to answer every complaint within two working days and to resolve it within ten.
If we cannot resolve it between us, these terms and any dispute arising from them are governed by the laws of Bangladesh, and the courts of Bangladesh have jurisdiction. Nothing here removes a consumer-protection right you have where you live that cannot be removed by agreement.
The rest
- If part of these terms is found to be unenforceable, the rest still applies.
- Not enforcing a term once does not mean we give it up.
- We may transfer these terms to another company as part of a sale or reorganisation of our business; your rights are not reduced by that.
- These terms, the Privacy Policy, the Cookie Policy, the Refund Policy, the Acceptable Use Policy and the Virtual Numbers Policy are the whole agreement between us.
